Going through an OSHA inspection does not necessarily mean that citations will be issued, and with our involvement, we can limit your company’s OSHA exposure during the inspection by effectively managing the inspection.  If and when citations are issued, we then work hand-in-hand with you to obtain the best possible outcome tailored for your company, whether that is through settlement or litigation.

Counseled a national logistics and storage company through over fifty inspections, the majority of which resulted in no citations being issued;

Counseled a multi-state food processing company through over twenty inspections, the majority of which resulted in no citations being issued;

Counseled an aluminum processing facility through the largest OSHA case in 2017, involving nearly 100 citations with fines totaling $2,000,000 (the citations were issued prior to our involvement), and countless subsequent inspections, which resulted in no citations;

Fatality of a worker in a trench struck by the falling bucket of a backhoe on a construction site. OSHA issued multiple repeat and serious citations. Due to our early intervention and response, the majority of the citations were dropped and the fines were significantly reduced at the informal conference.

Fatality at a large industrial facility involving a worker struck in the head by load of steel. Due to our involvement and response during the inspection, no citations were issued.

Fatality when an employee became entangled in a cable spooler at a cable manufacturing facility. OSHA issued multiple repeat and willful citations, with fines in the six figure range. After litigating for months, settled the case following a multi-day, mandatory settlement conference, with OSHA reclassifying the willful citations to other classifications, vacating a number of the citations, and reducing the fines significantly.

Fatality of a worker struck by a steel beam hit by a straddle crane. Due to our early intervention and response, and involvement of a consulting OSHA safety expert, only one serious citation was issued.

Fatality of a worker who suffocated as a result of confined space issues. Due to our early intervention, no willful citations were issued, and at the informal conference, OSHA vacated and reclassified a number of the citations issued and significantly reduced the fines.

Fatality of worker suffocated inside a silo filled with sand and gravel at a client’s manufacturing facility. OSHA issued multiple citations. Due to our proposed abatement efforts to prevent similar incidents in the future, several of the citations were dropped and fines were significantly reduced at the informal conference.

Career-ending injury to a worker’s back when he was knocked off a trailer by a crane load a concrete manufacturing facility. Due to our early intervention and response, no citations were issued.

Paralysis when a worker fell through a guardrail, falling five stories to the ground below. The client was issued multiple serious citations with fines in the five figure range. Litigated the case for months before OSHA agreed to vacate all citations.

Counseled countless employers through inspections involving amputations, and with our early intervention, often prevent citations from being issued altogether.

OSHA inspection resulted in an underground construction client being issued multiple repeat violations with fines in the six figure range. Took the case to trial, and succeeded in having a majority of the citations vacated and the fines significantly reduced;

OSHA inspection resulted in a recycling client being issued multiple repeat and serious citations with fines in the six figure range. Litigated the case until OSHA agreed to a favorable settlement, agreeing to vacate and re-classify the majority of the citations and significantly reduce the fines.
